Why Comerford Law Office?

James R. Comerford is a board-certified attorney who is authorized to represent veterans who are applying for disability benefits from the VA. He is also a member of the National Organization of Veteran’s Advocates (NOVA) and has helped thousands of Illinois veterans file for and receive disability benefits.

Why are VA Disability Benefits Applications Rejected?

Every case file must prove two elements. The first element is that you sustained an injury in the line of duty. The second element is that this injury prevents you from holding a job and is likely to do so into the foreseeable future.

While some applicants have injuries that are easy to prove (like the loss of a limb), other types of injuries can be more subtle. These include psychiatric injuries like PTSD or brain injuries that reduce cognitive ability, emotional control, or executive function. Similarly, Agent Orange exposure and Gulf War Syndrome can be difficult to prove, but the VA has begun paying benefits to veterans with symptoms of Gulf War Syndrome nonetheless.

How can a Veterans Benefits Attorney Help?

If your application is denied, we will go over the reason for the rejection. In the majority of cases, there simply is not enough evidence to support the claim made in the file and the VA is very protective of its disability fund. This does not mean that you cannot receive VA benefits; it merely means that your case file does not have enough information to support the claims that you are making.

Comerford Law Office will speak with your doctors to ensure they are providing the information necessary to prove your case. We will also work with vocational counselors who can provide testimony that your disability prevents you from sustaining gainful employment.
